A defendant shall be punished by imprisonment for six months.

The defendant shall pay 195,00 won to the applicant for compensation. The above compensation order shall be issued.

Punishment of the crime

"2016 Highest 7496"

1. On May 5, 2016, the Defendant posted a letter “sale of a tent-type gold item” on the online game hold by accessing the “the country of the wind” in Gyeyang-gu Incheon online game at the Ecscam located in Gyeyang-gu Incheon, and sells an item to the victim F who reported and contacted this letter.

A false statement was made.

However, even if the victim F receives money from the victim F, there was no intention or ability to transfer the item normally.

The Defendant received 20,000,000 won from the victim F to the corporate bank account in the name of the Defendant, and received a total of 1,660,300 won from the victims as shown in the attached crime list 1 through 9.

2. On April 4, 2016, the Defendant connected to the “the country of winding online game” in Gyeyang-gu Incheon, Gyeyang-gu, Incheon, and made a false statement to the victim H, stating, “The Defendant sold each person’s 1,30,000 won and each yellow 1,30,000 won in cash,” which was posted at G’s hosting windows.

However, in fact, the Defendant had the victim H transfer KRW 130,00 to G by means of the term “three-party frauds”, and the Defendant only intended to transfer from G one unit, each item, and one yellow lux, and did not have the intent or ability to transfer the game machine to the victim H.

The Defendant had the victim H transfer KRW 130,00 to a new bank account in G, and had the victims transfer KRW 730,000 in total to a third party’s account as shown in the attached Form Nos. 10 through 13, including the receipt of an item equivalent to the same amount from G, and received from the third party the transfer of items and game money equivalent to the same amount.

Accordingly, the defendant deceivings the victims to total amount of KRW 2,390,300.
