A defendant shall be punished by imprisonment for four months.

Punishment of the crime

1. On June 5, 2016, at around 16:35, the Defendant posted a false statement to the effect that “The Defendant would transfer money first to the victim C who reported and contacted this article,” by accessing the Internet online game “the wind country” and selling at KRW 220,000.

However, in fact, the defendant had the victim transfer the above money to D who is the seller of an item, and had the victim think of using the item from D, and even if the victim transfers money under the above name, he did not have the intention or ability to transfer the item to the victim.

Nevertheless, the defendant deceiving the victim as above and let the victim transfer the purchase price of an item 220,000 won to the bank account of D on the same day, and acquired pecuniary benefits equivalent to the same amount by receiving the game items in the amount of KRW 220,000 from D.

2. On February 18, 2017, the Defendant made a false statement to the effect that, by accessing the Internet online game “the winding country”, the Defendant reported the text posted by the Defendant as “sale of game items,” and that, “on the face of the transfer of money, send the game items” to the victim E.

However, in fact, the defendant had the victim remit money to F, and again had F transfer the money to G, so that the defendant thought that he would receive game items from G and did not intend to send the money to the victim even if the victim remits money to the above name.

Nevertheless, the defendant deceiving the victim as above and transferred 30,000 won as sales proceeds to the deposit account (H) in the name of F on the same day from the victim.
