A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2016. 8. 31. 14:20경 대구 서구 C아파트 102동 301호에서 D을 통하여 위조 상품 공급업자 E로부터 상표권자인 프랑스 ‘루이비통 말레띠에’사, 프랑스 ‘샤넬’사, 이탈리아 ‘구치오구치쏘시에떼퍼아찌오니’사, 룩셈부르크 ‘프라다 에스.에이.’사, 룩셈부르크 ‘보테가 베네타 에스에이’사, 영국 ‘버버리 리미티드’사, 이탈리아 ‘살바토레 페라가모 에스.피.에이.’사가 각각 대한민국 특허청에 그 지정 상품을 가방, 지갑, 핸드폰 케이스 등으로 정하여 등록한 ‘루이비똥(LOUIS VUITTON)', '샤넬(CHANEL)', ‘구치(GUCCI)’, ‘프라다(PRADA)', ‘보테가 베네타(BOTTEGA VENETA)', '버버리(BURBERRYS)', ‘살바토레 페라가모(SALVATORE FERRAGAMO)’와 동일유사한 상표가 부착된 가방, 지갑, 핸드폰 케이스 등을 공급받아 판매하고 남은, 별지 범죄일람표 기재와 같이 8,449점(정품 시가 약 28억 1,870만 원)을 양도 또는 인도하기 위하여 소지하였다.

Accordingly, the defendant infringed the trademark rights of the above trademark right holder.
