A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

【Criminal Power” On June 16, 2016, the Defendant was sentenced to one year of imprisonment and two months of imprisonment for a violation of the Act on the Control of Narcotics, Etc. at the Incheon District Court, respectively, and completed the execution of the sentence on November 20, 2017.

【Criminal Facts】

1. At around 02:28 on September 29, 2019, the Defendant: (a) expressed a great desire to “D” in front of “D” located in the Dongdong-gu, U.S., U.S. building C; (b) “A person under the influence of alcohol inflicted damage on a vehicle” after receiving a 112 report, to “A person under the influence of alcohol who was under the influence of a victim F (29 years of age) from the police officer affiliated with E Zone E-gu, U.S., U.S. Police Station E-gu, U.S., dong-gu, U.S., U.S., who was under the influence of the police officer of F (29 years of age).”

Accordingly, the defendant openly insultingd the victim.

2. 공무집행방해 피고인은 2019. 10. 29. 21:20경 고양시 일산동구 G에 있는 ‘H’ 앞 노상에서, ‘택시기사인데, 택시 손님이 택시비도 내지 않고 욕하고 시비한다’는 112신고를 받고 출동한 일산동부경찰서 E지구대 소속 경위 I과 경사 J로부터 귀가할 것을 요구받았으나 여러 차례 “아놔 씨발, 야, 담배하나 줘봐”라고 욕설을 하고, 순찰차에 다가와 손으로 순찰차의 조수석 손잡이를 붙잡고 놓지 아니하여 약 15분간 위 순찰차를 운행하지 못하게 하였다.

Accordingly, the defendant interfered with legitimate execution of duties of police officers.

3. Around 04:00 on November 7, 2019, the Defendant ordered “M” restaurant with a victim L, who is an employee in Yongsan-gu, U.S., U.S., U.K. to pay the food cost, etc., and the Defendant ordered the victim to pay the food value, etc. without having any intent or ability to pay the food cost, etc., and then, the Defendant acquired it by deceptioning the victim after being provided with 13,500 won in total, namely, 13,500 won in the market value from the victim’s seat.

4. The defendant shall interfere with his duties at the time and place specified in paragraph (3).
