A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. Violence and damage to property;

A. On September 8, 2019, around 23:30 on September 23:30, 2019, the Defendant asserted the victim C (the age of 47) and the alcohol in front of the Dongdong-gu B building, U.S. and assaulted the victim’s left face by hand on the ground of an unforeseen reason while drinking and staying home.

B. During the dispute with the victim as described in paragraph 1, the Defendant destroyed the victim’s property by taking smartphones from the victim’s gallon, and destroying the victim’s property by throwing away smartphones on the floor.

2. 3. 모욕 피고인은 2019. 9. 9. 00:25경 경기 고양시 일산동구 I에 있는 ‘일산동부경찰서 D지구대’ 내에서 제3항과 같은 이유로 현행범인 체포되어 인치된 상태에서 피해자 H에게 "개같은 년아, 씨발년아, 니 가족도 다 죽어, 씨발 개같은년이 나를 때렸어, 씨발 개같은년아 내 머리를 왜 잡아, 좆같은 년아."라는 등의 욕설을 하고, 피해자 E, 피해자 F, 피해자 G를 향해 “니 딸들 씨발 손모가지 날아간다, 어떻게 하나 봐봐, 니 자식도 손목 나가게 할 거야.”라는 등의 욕설을 하여 다른 사건의 관계자와 다수의 경찰관이 있는 자리에서 공연히 피해자들을 모욕하였다.
