A defendant shall be punished by imprisonment for two years.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Although the Defendant was not a narcotics handler, he purchased, smoked, or she was involved in marijuana as follows:
1. From August 19, 2016 to March 2018, the Defendant purchased marijuana: (a) transferred approximately KRW 180,000,00,000 to a person under whose name the Defendant sold marijuana at “C” on the deep web website (hereinafter referred to as “C”); (b) received the address of the bitcoin from the seller; and (c) received the place in which the hemp was concealed from the said seller, and purchased marijuana in a way of directly searching about 1g of marijuana concealed under the outside air condition of Seoul D Station; and (d) thereafter, from March 24, 2018 to March 18, 2018, the Defendant purchased marijuana in total at least 31 times, as shown in the attached Table of Crimes (1) and the sum of KRW 1,274,000,000,000,000 to “C” and “CE” and purchased it.
2. From August 2016 to March 2018, the Defendant smoked marijuana around 03:00 on August 20, 2016, at G parks located in Jung-gu, Incheon, Jung-gu, Incheon, with a hole inside it, and with a hole attached thereto, containing a fluoral volume and inhales smoke emitted from burning. From that time until March 25, 2018, the Defendant smoked marijuana over about 31 occasions, such as the daily list of crimes (2).
3. On April 30, 2018, around April 30, 2018, the Defendant purchased additional marijuana, and smoked from a foreigner on his/her name in California, California, California, the 20 U.S. dollars in return for the purchase of marijuana, and then inhaled the smoke generated by burning the hemp with a fire on one of the purchased hemps.
4. Purchasing additional marijuana and smoking around October 5, 2018 and around October 7, 2018;
A. On October 5, 2018, at around 23:00, the Defendant saw back a vinyler containing about 1g of marijuana from a foreigner under his/her name in the street near I hotel located in Yongsan-gu Seoul Metropolitan Government, and in return, 1.50,000 won in cash to a person who is not his/her name, and removed tobacco tobacco tobacco tobacco tobacco plant and as above.
