Reasons
Punishment of the crime
[criminal records] On April 23, 2015, the Defendant was sentenced to imprisonment with prison labor for larceny, etc. at the Seoul Central District Court on January 6, 2016 and completed the execution of the sentence.
[Criminal facts]
1. On May 13, 2018, at around 02:48, the Defendant: (a) opened a driver’s seat of the vehicle in Enish-gu, Ein, which was parked in the parking lot of 103, and did not correct the victim D; (b) opened a new card, Korean card, one card, Korean physical card, car card, car card, case bank card, name box, etc., which was kept in the small west located on the left side of the driver’s seat hand, and stolen it.
2. On May 13, 2018, the Defendant violated the law regarding fraud, attempted fraud, and credit-based financial business: (a) around 1:27, the Defendant purchased 2 game play 1,484,500 won in total or in excess of the ceiling on the credit card in G stores operated by the victim C in Seoul Jung-gu and the third floor; (b) one game play play; (c) one hand hand; and (d) two liquid film as described in paragraph (1). The Defendant attempted to pay 1,00,000 won in total on six occasions from the date of the occurrence of the following crime, including: (a) one card in the name of D, as stated in paragraph (1), presented as one of its card; and (b) paid 1,484,500 won in total from the date of the same day until 13:51 on the same day.
Accordingly, the Defendant, by deceiving the victims, acquired financial benefits equivalent to KRW 1,039,500, and attempted to acquire financial benefits equivalent to KRW 445,000, and used stolen credit cards.
3. On May 13, 2018, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit, including computers, contacts with Korean credit card banks of the victim D who stolen, such as paragraph 1, and settle 1,250 won of subway fares at around 10:31, 201.
