1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. 당사자의 관계 원고는 2012. 3. 26. 피고가 운영하는 병원(이하 ‘피고 병원’이라 한다)에서 부분적 설(舌)절제술 및 경부(頸部)림프절절제술(이하 ‘이 사건 1차 수술’이라 한다)을 받은 뒤, 경부의 출혈로 인하여 같은 날 다시 지혈을 위한 수술(이하 ‘이 사건 2차 수술’이라 한다)을 받은 자이다.
나. 이 사건 1차 수술의 경위 1) 원고는 2010.경부터 혀에 궤양이 있었는데 이로 인한 통증이 심해지자 2012. 2. 9. 피고 병원에 내원하였다. 2) 피고 병원 의료진은 궤양에 대한 조직검사와 목, 인두(咽頭) 부위에 대한 CT, MRI, PET CT(양전자컴퓨터 단층촬영) 촬영 검사 등을 시행한 결과, 원고의 혀 오른쪽 가장자리에 발생한 크기 1.1cm , 깊이 0.5cm 의 편평상피세포암(Squamous cell carcinoma)을 확인하였고, 이에 대하여 T1N0M0(종양의 크기가 2cm 를 넘지 않고, 림프절과 원격 전이가 없는 상태)의 1기 구강설암으로 진단하였다.
