Defendant

A shall be punished by a fine of 700,000 won, and by a fine of 6,00,000 won, respectively.

The above fines are imposed by the Defendants.

Punishment of the crime

1. A person who is not a marina society pursuant to the provisions of Defendant B Korean Racing Association Act shall not engage in any conduct similar to the riding voting for the racing conducted by a marina society to pay the profits of goods or property to the enemy, and anyone shall be prohibited from engaging in any conduct such as buying marina tickets on behalf of others or arranging such conduct for profit;

Nevertheless, on February 20, 2015, the Defendant: (a) obtained a password of “D” and “E” from the above site after joining the illegal horse site (C); and (b) operated a horse race track by using the method of hosting with points paid with points available to hosting and service money given at 20% of the total amount deposited on the same site as the amount deposited; and (c) from May 13:0 to 15:50, 2015, the Defendant received a request for the purchase of horse tickets from four persons, such as F, etc., who moved in the above private horse race track from around 13:0 to around 15:50, and paid dividends in accordance with the dividend rate, and operated the horse race track.

2. He shall not become the other party to a person who engages in any conduct similar to the riding voting for the racing conducted by a marina society pursuant to the provisions of Defendant A Korean Racing Association Act and who pays goods or financial benefits to the enemy or any other party to a person who engages in such conduct as an agent or intermediary for the purchase of marina tickets for profit;

Nevertheless, during the period from May 1, 2015 to 15:50, the Defendant became the other party to the horse race track B operating the private horse race track by requesting the operator of the private horse race track to receive the dividend during the enemy time and by requesting the purchase of approximately KRW 2.50,000 won on five occasions in total.
