Reasons
Punishment of the crime
[criminal history] On May 1, 2014, the Defendant was sentenced to one year of imprisonment for a crime of violating the Road Traffic Act (drinking driving) at the Daegu District Court, and completed the execution of the sentence at the Daegu Prison on June 20, 2014.
[Criminal facts]
1. On November 15, 2016, the Defendant: (a) driven a F knife vehicle without obtaining a driver’s license on the front side of the D Hospital located in Kimpo-si, Kimpo-si; (b) from around 30 meters to the front side of Kimpo-si, Kimpo-si; and (c) drive the F knife vehicle without obtaining a driver’s license.
2. On November 15, 2016, the Defendant violated the Guarantee of Automobile Compensation Insurance Act: (a) operated a F Kanknop vehicle that was not covered by mandatory insurance from the front of the D Hospital located in Kimpo-si, Kimpo-si, to the front of the Kimpo-si, Kimpo-si.
3. On November 15, 2016, the Defendant: (a) driven a fKan van on the front road of Kimpo-si, Kimpo-si without a driver’s license, as described in paragraph (1), on the road before Kimpo-si, Kimpo-si; (b) controlled H to a police box of Kimpo-gu, Kimpo-si.
In order to avoid punishment for driving without a license when the defendant was required by the above H to prepare a “motor vehicle operation report,” the defendant stated “I” in the name column of the above written statement, “J” in the resident registration number column, “L” in the Incheon Seo-gu K, and “L” and “I” in the contact column.
Accordingly, the defendant, for the purpose of exercising, forged a copy of the vehicle operation statement in the name of I, a private document on proof of facts.
4. On November 15, 2016, the Defendant: (a) presented a forged vehicle operation statement to H, as described in paragraph (3), before Kimpo-si, Kimpo-si; and (b) presented it as if it were genuine.
