A defendant shall be punished by imprisonment for six months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is operating "D Child Care Center" in Daejeon Jung-gu and "D Child Care Center" in Daejeon Seo-gu E, respectively.

No person shall receive a subsidy or appropriate a subsidy by fraud or other improper means.

1. In relation to the Daejeon-gu C Child Care Center;

A. On March 2010, the Defendant had access to the “nivers care integration system” system managed by the Ministry of Health and Welfare, using a computer located therein, and registered children F and G as a child care center student, and confirmed “the current status of use of the above children” as if F and others were attending the above child care center, and claimed KRW 3,50,000 per capita as child care fees for the above children. On March 25, 2010, the Defendant deposited the same money in the bank account (Account Number: H) managed by the Defendant from the State and local governments.

However, the above child care center was not established for the child care of the children aged 0 and 1 year old, and there was no fact that F et al. had received child care because F et al. applied to the child care center at the time.

The Defendant, including that, from that time until June of the same year, claimed KRW 3,307,00 in total as childcare fees for children F, etc., as shown in the attached Table 1, from that time, and received the same amount as the bank account managed by the Defendant from the State and the local government on the 25th day of each month.

Accordingly, the Defendant registered children F, etc. as children's children's children's children as children's children's children and received subsidies as above.

B. In early April 2013, the Defendant: (a) connected a childcare integration system to a “child care integration system” online using a computer located therein; (b) registered children I, J, K, and L as the above childcare center’s original students; and (c) confirmed “the current status of use of children” as if I et al. were attending the above childcare center; and (d) 238,000 won as childcare fees for I, M, N, J,O, K, and L, respectively.
