A defendant shall be punished by imprisonment with prison labor for three months.

Punishment of the crime

AGK (AGL) entered into a mobile phone sales consignment agreement with the victim AGM (AGN) who engages in the mobile phone wholesale business and the victim AGK entrusted the victim's mobile phone and received certain fees.

On January 2013, the Defendant received allowances of 5 to 100,000 won per customer from AGK in order to introduce a customer who applied for a mobile phone to AGK.

However, the Defendant sent a forged copy of his identity card to AGK as he did not obtain the consent, and ② allowed AGK to prepare an application for mobile phone entry in the name of the customer, and ③ to open the mobile phone by allowing the victim to submit it to the victim.

Through this, AGK obtains the opening fees and the profits from the mobile phone from the victim's test, and the defendant obtains the introduction fees for AGK test.

1. On February 7, 2013, the Defendant: (a) informed AGK of the personal information of AGO as “aGO filed an application for mobile phone membership” in the neighboring area of Gwangju; and (b) caused AGK to enter AG U mobile phone entry column in the AGP office located in Seo-gu, Seo-gu, Gwangju on the same day, the Defendant entered AGO’s resident registration number and name in the AG U mobile phone entry column and sign it following the name.

Since then, the defendant had AGK send a copy of the application by facsimile to the employees in charge of AG Q, a limited-liability company, a mobile phone opening agency.

As such, for the purpose of uttering, the Defendant, including forging and using a copy of “application for subscription to mobile phones under the name of the AO”, which is a private document related to rights and obligations, from February 18, 2013, shall file an application for subscription to mobile phones, which is a private document related to rights and obligations, from that time to February 18, 2013.
