A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On September 16, 2011, the Defendant was sentenced to eight months of imprisonment for a violation of the Korean Racing Association Act, and the judgment on November 12, 201 became final and conclusive.

Defendant, B, C, D, and E act as an agent for the purchase of the private horse tickets traded through the Internet horse site, and offered them to receive the fee, and then B took charge of the role of the private horse racing arrangement (tentatively called "rawling"). Defendant, C, D, and E joined the Internet horse site as a member of F, G, and then remitted the price to a non-person who manages the site by receiving the transfer of the price along with the request for the purchase of the private horse tickets, and share the role of purchasing the private horse tickets on the site.

Accordingly, from January 201 to July 201, the Defendant and B, C, D, and E received 81,00-2,000 won per sheet from those who purchased private horse tickets from the Defendant and then deposited the remaining money into a new bank account (I) designated by the operator of the horse site (E from March 201, 201; D from July 201, 201) and from the location of the Defendant’s residence, H apartment 101, 1206, PC and Nam-si in Dongdaemun-gu in Dongdaemun-gu, Dongdaemun-gu, Seoul, and H apartment 1206, from those who want to purchase private horse tickets using the Defendant’s account, such as the list of crimes in attached Form 1,00-82,00 won, and then received 1,000-2,000 won among them, and deposited the remaining money into the horse site’s account (I) designated by the operator of the horse site.

As a result, the defendant, B, C, D, and E committed an act of paying property to the public by causing them to commit an act similar to the horse riding voting through the Internet horse site with respect to the racing conducted by the public in collusion with the winners operating the horse site.
