A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

A person, other than a marina society, shall not engage in any act similar to a horse riding voting in connection with racing conducted in a marina society to grant property or financial benefits to the enemy.

Nevertheless, the Defendant committed an act similar to the horse riding voting by the Korean Racing Association (hereinafter referred to as the “Korean Racing Association”) in the course of purchasing the horse horse tickets on behalf of or arranging the purchase of the horse horse tickets by proxy, and acquired certain fees or directly purchase the horse tickets.

On April 4, 2008, the Defendant deposited KRW 10 million into the Agricultural Cooperative Account (Account Number E) in the name of the name of the Defendant, which is the borrowed-name account used by the Defendant, within the enclosed vehicle operated by the Defendant who was set up in front of the office branch of the Korea Racing Association located in Gangnam-gu, Seoul, at the request of the purchaser C to purchase the right of horse racing, and received the deposit of KRW 10 million from the F, which is the borrowed-name account used by the Defendant for the purchase of horse tickets, using it, purchased the private horse racing right concerning the horse racing conducted by the Korea Racing Association from the F, which is the operator of the private horse racing, and made C act as an agent or directly similar horse riding voting by C, and received money of KRW 1,200 from KRW 1,200 per private horse ticket (80,000) as a brokerage fee.

In addition, from April 4, 2008 to July 20, 2008, the Defendant received a deposit for the purchase of the private horse tickets from the purchaser of the private horse tickets in the same manner at the same place, such as the contents listed in the attached list of crimes, and received the deposit for the purchase of the private horse tickets from F of the private horse racing operator, and received the deposit for the total of KRW 2,504,910,000 from F of the private horse racing operator for 480 times in total, and received the deposit for the purchase of the right of horse tickets and received a certain fee in the middle.

As a result, the Defendant aided and abetted the act of similar horse riding voting (private horse racing operation) in F (Detention on April 14, 2009).
