Punishment of the crime

1. On March 15, 2014, when the Defendant was dismissed from office of the president of the Promotion Committee of the “C Regional Housing Association” at the special meeting of the Promotion Committee, the Defendant stolen 124 letters of consent obtained from local residents without permission in order to change the district unit plan kept in the treasury in the office of the Promotion Committee (208), and to apply for authorization to establish the regional housing association.

2. On March 15, 2014, the Defendant was dismissed from office as the Chairperson of the Promotion Committee for the Establishment of the C Regional Housing Association.

5. 20.경 자신을 지지하는 17명을 모집하여 위 지역주택조합과 별개로 ‘(가칭)E 지역주택조합’ 추진위원회를 발족한 후 그 무렵 불상의 장소에서 ‘C 지역주택조합’ 조합원들에게 [C 지역주택조합 추진위 사무실을 우리 동네 옆 F 아파트 상가에 이전하고 흩어진 조합원들을 한군데로 똘똘 뭉쳐 빠른 시일 내에 사업을 추진할 수 있도록 새로운 각오로 지역주택조합명을 ‘(가칭)E 지역주택조합’이라는 명칭으로 변경하여 새롭게 출발하려 합니다, 2014. 6. 30.까지 소유자동의서류를 징구하고 2014. 7. 초순 조합설립 창립총회를 개최하고 2015. 1~2월에 건물철거 및 토목공사에 착공하겠습니다 (가칭)E 지역주택조합추진위원회 추진위원장 A 올림] 이라는 내용이 담긴 안내문을 발송하는 등 허위사실을 유포하여 ‘C 지역주택조합’ 설립을 위한 추진위원회의 업무를 방해하였다.

Judgment

1. As to larceny, theft is established by infringing another person’s possession of property.

Here, the term “Possession” refers to a pure de facto relationship that actually controls any property, and is not necessarily consistent with the possession under the Civil Act.

Of course, even if it is a realistic control, the possessor must be the possessor.
