A defendant shall be punished by imprisonment for one year.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a managing director of the company (State)B established for the purpose of leasing passengers, passenger car transportation business, tourist travel brokerage business, etc., and is a substantial manager of the company.

On the other hand, the above B participated in the open bid or other competitive bidding conducted by each school in the National Integrated Electronic Procurement System of the Public Procurement Service in order to receive student transport services, etc. accompanied by academic travel and field experience activities of elementary, middle and high schools in Daejeon.

However, while the demand for chartered bus is concentrated because the school travel schedule overlaps at a specific time, in the school where each school is ordered, most of the vehicles provided for less than five years (not less than a vehicle-type 2006 type) in terms of student safety and prevention of accidents are proposed as a special condition for bidding qualification and contract execution.

Therefore, although the above B participated in the competitive bidding and entered into a student transport service contract with the school, it is difficult to perform the normal contract due to the lack of the number of vehicles meeting the above criteria at the time of the event on the day, the Defendant was willing to operate the business by submitting a copy of the motor vehicle registration certificate altered by the smoke, etc. on the side of the school and selling the vehicles that fall short of the above criteria in fact.

1. Alteration of, or alteration to, an official document;

A. On May 2012, the Defendant changed official document: (a) in the office of the above “B” located in Daejeon-gu, Daejeon-gu; (b) in order to submit the “D High School 2012 Year 2 to the purpose of checking the number of student transport vehicles,” the Defendant prepared and printed the “2005” in the “2007” column of the E registration certificate with the “2005” type, without authority, using a computer network protocol; and (c) in the name of the head office of the vehicle registration in the Daejeon-gu, Daejeon-gu, by means of a copy of the said “205” form.
