A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant entered into an entrustment contract with C Operation (State) D on sales and opening of mobile phones, and operated a mobile phone sales store in the name of “F” located in Busan Dong-gu E, Busan. The Defendant visited the place, opened a new mobile phone without the consent of customers, and received a delivery of a mobile phone terminal from D without the consent of customers. The Defendant was willing to sell it to the medium and large-scale mobile phone sales.

1. On April 9, 2015, the Defendant forged a private document: (a) stated in the mobile phone column of the SK service new agreement, “Aphone 6 (64G), 924,000 won delivery price, 878,000 won per unit; (b) stated in the mobile phone column of the mobile phone in the column of mobile communication “FE34, monthly rent 37,400 won; (c) “61,250 won” in the monthly payment column; (d) stated “name: date of birth: H: Address: date of birth; April 9, 2015”; and (d) renewed the new agreement with the head of G service, including the head of the 25th mobile phone service in the name of the private person and the right and duty of the private person, from that time to that date, by the 16th of May 15, 2015.”

On April 9, 2015, the Defendant at the event of the aforementioned investigation document submitted to the F a copy of the new SK service contract in the name of counterfeit G, and used it from that time to June 23, 2015, 56 of the mobile phone service new contract, as shown in the attached list of crimes (1), including submitting to the staff in charge of D who knew that the new contract was genuinely formed.

3. Fraud;

A. On April 9, 2015, the Defendant was guilty of the mobile phone device and the user fee, under the said G name.
