Reasons
Punishment of the crime
[Criminal history] On May 27, 2016, the Defendant was sentenced to imprisonment with prison labor for 8 months for special larceny, etc. at the Daegu District Court, and the judgment became final and conclusive on June 4, 2016.
[Criminal facts] The Defendant was a person who operated a mobile phone agency under the trade name of “C” in Daegu-gu.
1. Illegalation, such as forgery and event of a new contract, and money for short term, of a mobile phone in the name of D;
A. The defendant was a customer of the above mobile phone agency;
D At around October 31, 2013, the aforementioned mobile phone agency signed D’s name “D”, “F”, “G”, “G”, and “G”, and “D” on the applicant customer column without the above driver’s license, using the aforementioned driver’s license, and signed D’s license in the name column, “F”, “G” and “G”.
Accordingly, for the purpose of uttering, the defendant set forth the Chapter 1 (E) of the mobile phone service contract in the name of D, a private document related to rights and obligations.
B. The Defendant used the forged mobile phone service new contract as if it were a document duly formed, at the above date, at the same time, and at the above location, to an employee in the name of SK Telecom, who was aware of the forgery.

Defendant 1 sent a copy of a new mobile phone service contract which was forged as above to an employee without the victim SK’s name while working as D at the above date and at the above place, and had the above person with the name in mind open one mobile phone of the above E mobile phone, thereby obtaining property and property benefits equivalent to KRW 814,00 and KRW 147,310 of the end price.
2. Illegalation, such as forgery and event of a new contract and money for short term, of a mobile phone in the name of D;
A. The defendant was a customer of the above mobile phone agency;
D’s possession of a copy of the D’s resident registration certificate on December 3, 2013.
