Reasons
Punishment of the crime
The Defendant is the head of the “C” mobile phone sales store located in Dongdaemun-gu Seoul Metropolitan Government, and each person working as the general manager of the “E” mobile phone sales store located in Dongdaemun-gu Seoul Metropolitan Government D.
The defendant, as a result of insufficient living expenses, kept a copy of his identification card while opening the mobile phone, and opened the mobile phone sales agency by forging and using documents such as an application for subscription to the mobile phone in the name of the customer, and did so to raise the living expenses by selling it to the middle and high-speed telephone service provider.
1. On March 31, 2015, the Defendant forged private document: “E” mobile phone sales stores located in Dongdaemun-gu Seoul Metropolitan Government, stating that “F, to continue to use a mobile phone carrying device currently in use, must prepare a new service contract”; and F, using a pen, stating the name, address, and statutory life month of the “T Service New Contract” in Chapter 1 of the “T Services New Contract,” which is kept there, entered the name of the pen, serial number, new subscription information, payment method of charges, etc. in addition to the name.
As a result, the Defendant, for the purpose of uttering, forged a copy of a new T service contract in the name of F, which is a private document on rights and obligations, from that time to June 23, 2015, and forged five copies of a private document in the name F and G in a total of five times, i.e., a crime one set up during the period from June 23, 2015.
2. The Defendant at the time and place specified in the foregoing paragraph 1, submitted and used the forged contract as if it were a document duly formed to the employee in charge of opening mobile phones, SK Telecom Co., Ltd., which could not know the fact as stated in the foregoing paragraph 1, as well as from that time until June 23, 2015.
