A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

"2017 Highest 8834"

1. Around October 22, 2017, the Defendant violated the Road Traffic Act (unlicensed driving) driving on the roads near Gangnam-gu Seoul, Seoul to the front roads in Gangnam-gu, Seoul, without obtaining a driver’s license in approximately 2km section from around 2km to the front roads in Gangnam-gu Seoul.

2. The Defendant in violation of the Guarantee of Automobile Accident Compensation Act is a holder of Done Star Co., Ltd.

No automobile which is not covered by mandatory insurance shall be operated on a road.

The Defendant, at the time and place specified in paragraph (1), operated the said van without mandatory insurance.

3. The Defendant is a person who is engaged in driving a Dsch Rexroth under the Act on Special Cases concerning the Settlement of Traffic Accidents.

On October 29, 2017, at around 22:20 on October 29, 2017, the Defendant driven the above van without obtaining a driver's license, and transferred the front road of Gangnam-gu Seoul to the back station distance.

At the time, there were night and people at the right edge of the defendant's moving direction, so in such a case, a person engaged in driving a motor vehicle has a duty of care to safely make a right-hand by reducing speed and checking well the right-hand and right-hand side of the motor vehicle.

Nevertheless, without obtaining a driver's license, the Defendant was negligent in not thoroughly driving the front side of the road, and the victim E (70 years of age) was placed at the right side of the said passenger car.

As a result, the Defendant suffered injury to the victim, such as extreme flag, five extreme flags, etc., which require approximately six weeks of medical treatment due to such occupational negligence.

On August 14, 2009, the Defendant was sentenced to a fine of KRW 3 million for a violation of the Road Traffic Act (driving) at the Suwon District Court on August 14, 2009, and on August 29, 2013, the Defendant was sentenced to a fine of KRW 7 million for a violation of the Road Traffic Act (driving) at the Sungnam Branch of the Suwon District Court on August 29, 2013.
