Defendant shall be punished by imprisonment for a term of one year and six months.

However, the above sentence shall be executed for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

[Criminal Power] The Defendant, at the Changwon District Court on October 22, 2018, received a fine of KRW 5 million due to a violation of the Road Traffic Act (driving) in the Jinwon District Court on October 22, 2018, has the criminal records subject to punishment for drunk driving.

【Criminal Facts】

1. Crimes committed on or around December 28, 2019;

A. On December 28, 2019, the Defendant violated the Road Traffic Act (unlicensed driving) driving at around 200 meters from the front of the Jinju City to the front of the Jinju City, without obtaining a driver’s license, on a section of about 200 meters from the front of the Jinju City to the front of the Jinju City.

(b) No motor vehicle owner who violates the Guarantee of Automobile Accident Compensation Act shall operate any motor vehicle on a road which has not been covered by mandatory insurance;

Nevertheless, the Defendant, at the same time and place as Paragraph (1) of Paragraph (1), operated the Done Star Engine, which was not covered by mandatory insurance.

2. Crimes on April 21, 2020;

A. On April 21, 2020, the Defendant: (a) violated the Road Traffic Act (driving) and the Road Traffic Act (driving without a license); and (b) driven a Done Star under the influence of alcohol concentration of 0.168% without obtaining a driving license for a vehicle driving license for about five meters on the road after working in Jinju-si E on April 21, 202.

As a result, the Defendant violated the prohibition of driving under the influence of alcohol more than twice, and at the same time, operated a motor vehicle without obtaining a driver's license.

(b) No motor vehicle owner who violates the Guarantee of Automobile Accident Compensation Act shall operate any motor vehicle on a road which has not been covered by mandatory insurance;

Nevertheless, the Defendant, at the same time and at the same place as Paragraph 2(a), operated a Done Star car which was not covered by mandatory insurance.
