Punishment of the crime
Defendant
A was a candidate for the election of the NAF director of the NAF implemented on January 29, 2015, and the defendant B was a representative of the LF member of the NA, and the defendant C was a former president of the NAF.
1. No defendant A or B shall provide money, goods, entertainment, or other property benefits to any member or his/her family member, or any institution, organization, or facility established and operated by a member or his/her family member, for the purpose of having him/her or a specific person elected as an executive or representative of a local agricultural cooperative or preventing him/her from being elected;
Nevertheless, around January 7 through 8, 2015, Defendant A asked Defendant B to “O and P deliver the said money bags to the election campaign in connection with the director election,” and Defendant B sent two money bags containing KRW 500,000,000,000 to Defendant B’s house in Q. On the front of the house of P in Q, around January 9, 2015, Defendant B received the said money bags, and requested Defendant B to support Defendant A in the election of the director of the NA by providing KRW 500,000,000 to P, a regional representative of the NA L, and KRW 500,000,000 from R’s ward room in the name of the 15:0 of the same month, and at around 11:00 of the same month, to 50,000,000 won to NA, a local representative of the NA.
As a result, the Defendants conspired to offer money of KRW 1 million in total to 500,000,000 to the representative O and P for the purpose of having Defendant A elected the NA director election.
2. Defendant A
(a) A person inducing purchase or interest shall have money, goods, entertainment, or other property benefits to a member or his/her family member, or an institution, organization, or facility established and operated by a member or his/her family member, for the purpose of getting him/herself or a specific person elected or not elected as an executive or representative of a local agricultural cooperative;
