A shall be punished by a fine for negligence of KRW 2,000,000, and by a fine of KRW 3,000,000.

The Defendants respectively.

Punishment of the crime

1. Defendant A

(a) In order to operate a livestock products sales business, any person shall be equipped with the facilities under relevant Acts and subordinate statutes and report to the administrative authorities;

Nevertheless, the Defendant did not report the sales of livestock products to an administrative office, and sold food eggs equivalent to KRW 16,150,000 in the market price to an unspecified number of customers who found in the above shop for the above period while operating the store under the trade name “F” from February 25, 2016 to June 9, 2016.

Accordingly, the Defendant operated livestock products sales business without reporting to the administrative authorities.

(b) No livestock products, the standards for labeling of which are determined, shall be sold, nor processed, packaged, transported or displayed for sale, unless the standards are indicated;

In order to sell food eggs, the Defendant sold food eggs equivalent to 16,150,000 won at an unspecified number of customers suffering from the same date, time, and place as described in Paragraph 1, although the date and time of production should be indicated, the Defendant sold food eggs to an unspecified number of customers suffering from the above store.

Accordingly, the Defendant sold livestock products without marks that meet the standards.

2. No livestock products shall be sold, or processed, packaged, transported, or displayed for sale, unless the standards for labeling are indicated in accordance with such standards;

From August 25, 2015 to June 23, 2016, the Defendant sold 30 food eggs of KRW 168,371,100 to 30 business entities, such as “H, without indicating the production date and distribution deadline of food eggs,” “F, in Daejeon E, without indicating the production date and distribution deadline of food eggs.”

Accordingly, the defendant is in conformity with the standard.
