A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. At around 00:10 on Nov. 13, 2019, the Defendant: (a) opened a door of the victim C-owned Dworket Nos. C at the first floor parking lot of Bupyeong-gu Incheon, Bupyeong-gu, Incheon; and (b) stolen the said vehicle with a physical card (F) in the victim’s name, which was located in the contact lock between the driver’s seat of the said vehicle and the chief lighting.

2. Computer, etc. fraud, fraud, or violation of the Specialized Credit Financial Business Act;

A. At around 01:50 on November 13, 2019, the Defendant paid user fees at the “H” bank located on the sixth floor of the Kucheon-gu Seoul Special Metropolitan City G building, and paid KRW 10,000 by inserting the e-bank cke card that was stolen in the unmanned shock machine installed therein, and settled KRW 50,000 in the same manner at the same place, around 01:51 on the same day, and around 50,000 in the same manner.

As a result, by inputting information without authority into a computer or any other information processing device, the Defendant acquired a total of 110,000 won from the victims of the above PC room business owner's name failure, and used a stolen PC card.

B. On November 13, 2019, around 03:07, the Defendant purchased goods at the “J” convenience store located in Seocheon-si, Seocheon-gu, Seocheon-si, and presented the e-bank e-bank e-mail card that was stolen to an employee of the place of the purchase and paid the price as if he was the legitimate licensee of the above card, and received from the above employee the goods worth KRW 11,000,000, total market value of the victim’s name and unclaimed box, the owner of the above convenience store.

Accordingly, the Defendant deceiving the above employees and received property from the above employees, and used the stolen cream card.

C. On November 13, 2019, the Defendant calculated an entrance fee from “K” in the 7th floor of the Kucheon-gu Seoul Special Metropolitan City G building, Seocheon-gu, Seoul Special Metropolitan City, and, at the same time, presented the e-bank cream card that was stolen to the employees of its location as if the said card was the legitimate licensee of the said card, and paid KRW 9,000 as the entrance fee.
