Punishment of the crime
"2019 Highest 2602"
1. At around 18:30 on July 28, 2019, the Defendant, under the influence of alcohol, destroyed green bags containing one cell phone (public machinery) of LG X500 mobile phones (public machinery) located in the front of the victim D, seated with a fluor of the vehicle due to the influence of alcohol on July 28, 2019, the Defendant: (a) one, Samsung GG X50 mobile phone (public machinery); (b) one, Bluluos earphone; and (c) one, KBNND card; (d) one, KBNN Nown C card; (e) five, 10,000 fluoric acid; and (e) one, fluoric acid.
2. Fraud and violation of the Specialized Credit Finance Business Act;
A. On July 28, 2019, the Defendant: (a) at the “F restaurant located in Yongsan-gu, Yongsan-gu; (b) on July 28, 2019, the Defendant, like paragraph (1), by deceiving the victim under his/her name as if he/she was his/her own card; and (c) purchased Scenic and Soft-gu 1 disease equivalent to 29,000 won, and paid the price by presenting the said physical card as if the Defendant was the legitimate licensee of the said physical card.
Accordingly, the Defendant, as seen above, by deceiving the victim, received property, and used the stolen KBnae Card.
B. On July 28, 2019 and around 20:07 and around 21:02, the Defendant paid the amount by suggesting that the Defendant was the legitimate licensee of the said card, as in paragraph (1), the KB National Round Card that was stolen, as in paragraph (1), was his/her card, by deceiving the victim under his/her name as if the card was his/her own card, and ordering liquor amounting to KRW 100,000.
Accordingly, the Defendant, as seen above, by deceiving the victim, received the property, and used the stolen KB Round card.
C. On July 28, 2019, the Defendant: (a) arrived at the J-si in Gyeyang-gu, Seoyang-gu; (b) on July 28, 2019, Seoyang-gu; (c) around 22:10 of the same day after having arrived at the K-si, Seoyang-gu, Seoyang-gu; and (d) deceiving the victim under his/her name as if he/she was his/her card; and (c) deceivings the victim under his/her name; and (d) amounting to KRW 7,900.
