A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"200 Highest 1059"

1. On October 13, 2019, the Defendant: (a) around 23:00 on October 23, 2019, the Defendant: (b) obtained 1 copy of the E Bank C’s check (F) that the victim D lost; and (c) did not take necessary procedures, such as returning it to the victim.

2. Fraud or violation of the Specialized Credit Finance Business Act;

A. On October 14, 2019, around 00:03, the Defendant purchased tobacco at the H convenience store located in Busan Seo-gu G, Busan, and presented as if he was a legitimate licensee the E-bank cream card in the name of D obtained as stated in the foregoing paragraph (1) to the victim non-employee, thereby having the victim settle the tobacco price of KRW 22,50,00, thereby having the victim obtain the same pecuniary benefits and using the lost crow card.

B. On October 14, 2019, around 00:008, the Defendant purchased tobacco and presented the E-bank Card in the name of the victim non-employee, as described in the foregoing paragraph 1, to the victim as if he was a legitimate licensee, thereby allowing the victim to pay 5,000 won of the tobacco value, thereby obtaining the same pecuniary benefits, and using the lost e-mail card.

C. On October 14, 2019 and October 14, 2019, around 00:27 and around 01:13, 201:13, the Defendant: (a) presented the e-bank ck card in the name of the victim twice as if he/she was a legitimate licensee; (b) provided the e-bank ck card in the name of the victim twice, as described in the above paragraph (1), thereby allowing the victim to settle the e-bank 1,500,000 won in total; and (c) used the lost ck card.

On October 14, 2019, the Defendant settled accommodation expenses at the inn of the north-gu Busan, Busan, and the victim non-employee, as described in the above paragraph 1, is a legitimate licensee.
