A defendant shall be punished by imprisonment for not less than nine months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant

A serving in the "C", which is an E-conditioner installation company, was a person retired from office in June 2017, and was born to raise living expenses by cutting off the air-conditioner parts stored in the above "C" office, which were caused by large debts.

1. On June 26, 2017, around 04:55, the Defendant: (a) went into the “C” office for the operation of the Victim E located in Guriri-si; (b) opened a closed door and intrudes into the office; (c) then, the Defendant was carrying back the air conditioner part in FSM3, which was prepared in advance for the total market price of HIV Line 4,042,440 won, such as HIV Line 4, which was owned by the victim.

2. Larceny;

A. On July 6, 2017, around 05:30 on July 6, 2017, the Defendant: (a) loaded the injured party’s small roll market value of KRW 783,720 on the said vehicle, which was kept outside of the office at the above place; and (b) stolen it.

B. On August 11, 2017, around 04:30, the Defendant: (a) loaded at the same place as above; (b) the amount equivalent to KRW 653,100 at MN 5 Rawls’s market value, in the manner described in the foregoing A; and (c) stolen it.

3. On August 17, 2017, at H, the business partner of Hanam-si, Hanam-si, G, the Defendant made a false statement to the victim I, the business owner of G, as if C was an employee, and “the Defendant has received air-conditioning materials”.

However, the defendant was retired from C, and was planned to prepare personal living expenses by disposing of the above materials.

Accordingly, the defendant deceivings the above victim as above, and he received from the victim the amount equivalent to 77,480 won at the 12 roll market price from the victim, i.e., he obtained from the victim.
