1. Defendant A shall be punished by imprisonment for eight months.

except that the sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Defendant A

A. At night, around 02:20 on February 5, 2018, the Defendant: (a) intruded into the open site of E in Goyang-gu, Goyang-gu, Gyeonggi-do; and (b) laid off electric wires of an amount equivalent to KRW 700,000,000,000 in the market price managed by the victim F, who was located there; (c) and (d) cut off the aircraft into G beer-gu cruise cruises cruises.

2) On February 9, 2018, around 01:00, the Defendant: (a) intruded into a construction site on the H building in Pakistan-si, Gyeonggi-do; and (b) laid off and stolen electric wires of approximately one million (200 km) at the market price managed by the victim I in front of the container office; and (c) loaded them into Gerro cruise cruise cruises, waiting in advance.

B. Around February 28, 2018, the Defendant: (a) entered the safety passage at the construction site of the new building in Gangseo-gu Seoul Metropolitan Government, Gangseo-gu, Seoul; (b) cut off a simple warehouse lock of the first floor above the construction site by cutting off and destroying it into a steel clickner; and (c) cut off electric wires of at least 40 cc (370km) and UTP cable 1 boxes with electric wires of at least five million won at the market price managed by the victim K at the same place; and (d) cut off the electric wires of at least 5 million won in the air and the air in advance.

2. Defendant B is a person who is engaged in trading of scrap iron, electric wires, etc. with the trade name of “M” L in Gyeyang-gu, Gyeyang-gu, Gyeonggi-do.

A. At around 15:00 on February 5, 2018, the Defendant purchased electric wires of 700,000 won (23 km) at the market price of the victim F owned by M that he stolen, such as Section 1-A (A) from M.

In such cases, the defendant, who is engaged in trading business, such as scrap iron, has a duty of care to verify whether he/she is stolen by ascertaining the personal information about A, while checking the process of acquiring electric wires and the motive of selling electric wires.

Nevertheless, the Defendant neglected this and neglected the judgment on the stolen water, but purchased electric wires at KRW 1.60,00 by negligence.

Ultimately, the Defendant committed the above occupational negligence.
