Reasons
Punishment of the crime
[Basic Facts] Defendant A is a person working as the head of the technology team in the victim F Co., Ltd. F (hereinafter “victim”) who manufactures and sells semiconductor equipment, etc. operated by E in Nam-gu, Nam-gu, Nam-gu, the Nam-gu, and Defendant B is a person who is engaged in the trade of electric wires and other used materials while operating the secondhand goods with the trade name of “H” from G.
[Criminal facts]
1. The Defendant: (a) stored high-priced semiconductor materials in the materials and warehouses of the Victim Company; and (b) stolen materials by taking advantage of the Defendant’s easy access to them; (c) sold them and received the proceeds therefrom, and used them as a device.
A. A thief, while working for the victim company around July 10, 2017, the Defendant stolen semiconductor-related materials worth KRW 116,130,000, total market price by the same method over 111 times from around that time to around August 20, 2017, including the theft of semiconductor equipment, materials, etc., after having entered a material warehouse that stores semiconductor equipment, materials, etc. by making use of the gaps in which surveillance was neglected by making it difficult.
B. On August 14, 2017, around 05:42, around 05:42, the Defendant: (a) intruded into the victim company’s work site, which is a structure that said E, in the same manner as described in paragraph (1) of the above paragraph; and (b) stolen it with materials equivalent to KRW 3,00,000,000 in the market price; and (c) stolen it.
2. Around August 2, 2017, Defendant B purchased materials, such as KRW 14 million at the market price, which was stolen by A as described in Section 3 of the List of Offenses, from around August 2, 2017.
In such cases, the personal information, etc. of the seller shall be verified and entered in the sale of used materials, etc., and the details of the acquisition of such materials, motive for the sale, and transaction prices shall be appropriate.
