피고인은 2017. 4. 3. 14:12경 필리핀 마닐라 C에 있는 ‘D’ 골프연습장에서, 자신과 교제중인 E의 친구인 피해자가 E에게 돈 많은 유부남을 만나는 얘기를 하고, 술집에 데리고 다니면서 업소에 다니라고 권유하는 것에 대해 화가 나, 휴대전화기를 이용하여 피해자에게 “요즘 꼰대 만나서 단물 잘 빨아먹고 있나 제비들 만나면서 떡 치고 돈 뿌리고 다니는 거 꼰대가 알면 좋아하겠다. 날짜까지 확인되는 힘들게 구한 니 동영상 하나 있는데 꼰대가 보면 엄청 좋아할 꺼 같네 긴말 필요 없고 오늘 5시까지 2억 준비해 놔라. 신고하던지 돈해주던지 니가 결정하고 오늘 5시까지 답장 없으면 위에 말한 대로 그대로 진행된다는 것만 알아둬라 ”, “누구한테 떠벌리고 다니는 날에는 니 물주와 그 부인, 니 지인들까지 동영상 편집해서 싹 다 한방에 보내줄게 ”라는 카카오톡 문자메시지를 전송한 것을 비롯하여 그 무렵부터 2017. 4. 5.경까지 별지 범죄일람표 기재와 같이 총 8회에 걸쳐 같은 취지의 문자메시지를 전송하였다.
