A defendant shall be punished by imprisonment for not less than eight months.

An applicant for compensation shall be dismissed.

Punishment of the crime

[criminal record] On July 10, 2014, the Defendant was sentenced to imprisonment with prison labor for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Daejeon District Court on July 15, 2015 and completed the execution of the sentence at Daejeon Prison on July 15, 2015. On November 29, 2016, the same court was sentenced to four months of imprisonment with prison labor for larceny and the said judgment became final and conclusive on February 22, 2017.

[Criminal facts] The Defendant committed the following crimes in a state that he or she lacks the ability to make decisions due to military registers barriers.

"2016 Highest 2377"

1. From around 13:50 on July 6, 2016, the Defendant: (a) cut off the property of KRW 2,946,00 in total amount of KRW 2,00,00, the market price of the E-1st floor “F clothes store” located in Cheongju-si, a considerable amount of Cheongju-si; (b) KRW 129,000, the market price of which is 52,000, and KRW 40,000, which is a victim G, by inserting one set of half selling sportss in the future; and (c) around that time, from around October 14, 2016 to around October 14, 2016, the Defendant stolen the property of KRW 2,946,00,00 in the same manner, as indicated in the list of crimes in attached Form.

2. Violation of Acts in financial business specializing in fraud and credit finance;

A. At around 11:45 on October 13, 2016, the Defendant: (a) purchased two gold-free gold-frees equivalent to the total market value of KRW 936,000 from the bank of “I” located in “I” in “Cheongju-si, Cheongju-si; (b) presented the completion of the Samsung Card of J, as indicated in [Attachment Table 1] of the Crimes List No. 6, and used a stolen credit card with two gold-frees issued from the victim K, and two gold-frees issued by the Defendant.

B. On October 14, 2016, around 12:54, the Defendant purchased a net gold sheet of KRW 2,434,000 of the market price from “M” L in Seo-gu, Seo-gu, Seocheon-gu, Seocheon-gu, Seocheon-gu, and used a stolen credit card by presenting N’s her credit card completion as if it was one of his own credit cards as indicated in [Attachment 1] No. 7 of the List of Crimes in the annexed Table 1 of the above Act.

The defendant of "2016 Highest 2594" shall be the defendant on June 2016.
