The sentence against the accused shall be determined by a fine of KRW 3,00,000.

When the defendant does not pay the above fine.

Punishment of the crime

1. The Defendant: (a) around 13:00 on January 25, 2013, the victim B, parked on a road near the social welfare center in Songpa-gu Seoul, Songpa-gu, Seoul, took advantage of the gaps in the victim B’s car located in the steering seat, and thus, stolen the victim’s knee and 300,000 won in cash, and two credit cards.

2. The Defendant attempted to commit fraud at the “D” shop located in Songpa-gu Seoul Metropolitan Government on January 25, 2013, the Defendant, as described in the foregoing paragraph (1), by deceiving a business owner, who was not aware of the victim’s name as if he was his card, and attempted to purchase precious metal worth KRW 1,061,000, which is the market price, but did not go through an attempted attempt.

3. Fraud or violation of the Specialized Credit Finance Business Act;

A. On January 25, 2013, around 20:14, the Defendant, as indicated in the foregoing paragraph (1), conspired with “F precious metals” located in the Si, Ma-gu, Ma-gu, Ma-dong, Ma-dong, Ma-si, Ma-dong, by presenting the stolen B’s corporate rain card to the business owner whose name the victim could not be identified as if he/she was his/her credit card was the victim, and deceiving him/her by signing and settling the sales slip, thereby purchasing one net gold sheet from the victim, and using the stolen credit card unlawfully.

B. On January 25, 2013, at around 20:20, the Defendant, as indicated in the foregoing paragraph (1), proposed to the business owner who was stolen B’s corporate secret card as indicated in the foregoing paragraph (1) to sign and settle sales slips by presenting it to the business owner whose name the victim is unknown as if he/she was his/her credit card, and deceiving him/her by signing and settling the sales slips, and purchased one half of the net amount of KRW 271,000 from the victim, and used the stolen credit card unlawfully.
