The facts charged of the instant case [basic facts] E branch church in Jung-gu Seoul Metropolitan Government (hereinafter referred to as the "E branch church") was established as a branch church of F (hereinafter referred to as the "Defendant's religious order") around December 13, 1972. The above church purchased the land due to the donation of new islands and completed the registration of ownership transfer under the name of G or H, which is the supervision of the defendant's religious order, and completed the registration of ownership transfer under the name of the defendant's religious order, with the donation as the ground for registration. After the above land was determined as 198 square meters prior to D (hereinafter referred to as the "instant land"), and the building of five-story religious facilities on the ground of Seoul Jung-gu Seoul Metropolitan Government D (hereinafter referred to as the "building of this case") was constructed on the instant land around 1993 due to the donation of the new church of this case and completed the registration of ownership transfer under the name of the defendant's religious order.

A school juristic person (hereinafter referred to as "the above school juristic person") is a school juristic person established on January 20, 1982 after obtaining permission for its establishment on December 26, 1981 for the purpose of providing the defendant's religious order with professional education and general university education.

On the other hand, when fundamental property for profit-making purposes for applying for authorization for the comprehensive university of the above J&D schools was needed, the defendant's religious order completed the registration of transfer of ownership in the name of the above private teaching institute on the ground of the instant land on September 10, 1996, and each donation on September 12, 1996 (hereinafter "the instant donation agreement") on the instant building on September 12, 1996.

However, there is a dispute between G pastors who are supervised by the defendant's religious order and his relatives, K pastors and L pastors, and L pastors established a new religious order (after the change to N'F's "F" under the supervision of the defendant's religious order (hereinafter "victim's religious order"), separate from the defendant's religious order, and after the change to N'F's "F" under the supervision of the defendant's religious order (hereinafter "victim's religious order"), and K pastors around that time.
