Defendants are innocent.

1. The facts charged: (a) on December 13, 1972, the E Religious Organization FIE (hereinafter referred to as the “FIE”) established as a branch church of the E Religious Organization (hereinafter referred to as the “Defendant Order”); (b) the above church purchased the land under the name of G, which is the supervision (representative) of the Defendant’s religious order; (c) completed the registration of ownership transfer under the name of the Defendant’s religious order; and (d) completed the registration of ownership transfer under the name of the Defendant’s religious order by again making the donation as the reason for the registration of ownership transfer; and (e) the above land was designated as its domicile and area with 198 square meters (hereinafter referred to as the “instant land”) prior to the Seoul Western-gu Seoul Metropolitan Government following the division and merger process; and (e) the building of five-story religious facilities (hereinafter referred to as the “instant building”) on the land of this case built around 193 due to the donation of the above church, and completed the registration of ownership transfer in the name of the Defendant order.

A school juristic person which is a victim (hereinafter referred to as "the above school juristic person") is a school juristic person established on January 20, 1982 after obtaining permission for its establishment on December 26, 1981 for the purpose of conducting professional education and general university education for the defendant's religious order.

On the other hand, when the fundamental property for profit-making purposes for applying for authorization for the above J University was needed, the defendant's religious order completed the registration of transfer of ownership in the name of the above J University on September 10, 1996 for the land of this case and on September 12, 1996 for the building of this case on September 12, 196 for each donation (hereinafter "the contract of this case").

However, there is a dispute between G pastors under the supervision of the defendant's religious order and his relatives, K pastors and victims L pastors, and K and L pastors, separate from the defendant's religious order on 2001, are now changing into the "E society" under the supervision of the MM religious organization (hereinafter "victim's religious order") after the new religious order.
