A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. The Defendant, at the Seoul Western District Court on February 12, 2015, was sentenced to a two-year suspended sentence of imprisonment for a violation of the Road Traffic Act and a violation of the Punishment of Violences, etc. Act (a collective deadly weapon, etc.), and the appeal was dismissed by the same court on November 27, 2015. On March 10, 2016, the appeal was reversed by the Supreme Court on March 23, 2016 on the ground of the amendment of the relevant statutes. Accordingly, the Defendant was sentenced to a three-year suspended sentence of imprisonment for a violation of the Road Traffic Act and a special injury at the Seoul Western District Court on October 1, 2016, and the said judgment became final and conclusive on July 1, 2016.
2. Criminal facts;
A. On March 3, 2016, the Defendant violated the Road Traffic Act (Non-licenseless Driving) driving a Switzerland car on the road near the claim distance in Jung-gu Seoul, Jung-gu, Seoul, without a driver’s license, and discovered the traffic police officer’s patrol vehicle while driving a Switzerland car on the road near the claim distance in Jung-gu, Seoul, Seoul, and thereby driving the said Switzerland car on the road while damaging the trend of the patrol vehicle and escape.
B. The Defendant violated the Road Traffic Act, at the same time and place as the above A. At the time and place, as described in the above A. A., when the traffic police officers were found to have been invaded by the central line, the judgment as described in paragraph 1 continues, resulting in a burden on the possibility of heavy criminal punishment, and the Defendant started driving the above SP car to immediately escape from the speed of patrol.
The Defendant driven along a one-way path, and repeated the dangerous act by continuously overcoming the median line and not securing the safety distance with other vehicles while passing the other vehicles with the scambing.
Accordingly, the defendant driving a motor vehicle, thereby threatening or endangering others or causing danger to traffic.

The Defendant violated the Road Traffic Act (the U.S. measure after the accident) was able to escape from the attack of the patrol vehicle as above.
