A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
On October 16, 2009, the Defendant issued a summary order of KRW 1 million for a crime of violating the Road Traffic Act (drinking driving) at the Changwon District Court, and on April 24, 2017, the Defendant issued a summary order of KRW 2.5 million for the same crime at the same court.
1. On April 2, 2018, the Defendant damaged a special public object: (a) around 23:50, while driving a cargo vehicle of 117 in and outside of Kimhae-si; (b) while driving a cargo vehicle of Da on the front of the Hah High School, many police officers, such as slope E belonging to the police station D in the Kim Sea, who fled, were found to control drinking and escape; (c) the Defendant was able to get a string of the F rocketing patrol vehicle driven by E.
Defendant 1, while escaping from the above patrol vehicle's attack, was on the road in front of the annual branch office located in Kimhae-si, while her escape, had the above patrol vehicle operated rapidly to see the said patrol vehicle, and had the above patrol vehicle, which was in attack, her back part, of the said cargo vehicle.
Accordingly, the Defendant, carrying dangerous articles and damaged the patrol 1,983,397 won, which is an object used by public offices.
2. The Defendant, from around April 2, 2018 to around 23:50 on April 2, 2018, committed a violation of the Road Traffic Act (drinking driving), and the Road Traffic Act, the Defendant: (a) was under the influence of alcohol at 0.171% of alcohol while driving the said cargo without obtaining a driver’s license from around 117 to around 23:5 of the same day; and (b) was under the influence of alcohol at 0.171% in front of the annual branch office located in the same city and in front of the same city; and (c) was under the influence of alcohol at around 0.171% in blood; (d) was under the influence of alcohol; (e) was under the influence of alcohol; (e) was under the influence of alcohol; (e) obstructed the normal traffic flow of the said truck; (e) was under the influence of the central line of the 3-lane Kimhae, a three-lane-lane road; and (e) was under the influence of traffic changes on several occasions.
Accordingly, the defendant was punished not less than twice by driving a motor vehicle while under the influence of alcohol.
