Defendants shall be punished by imprisonment for six months.

However, from the date of the conclusion of the judgment, the defendants are above two years.

Punishment of the crime

A is the actual owner of H amusement rooms in G and the first floor, and Defendant B is the owner and employee of the above entertainment room in the name of the above entertainment room, and Defendant C is the exchange in cash where customers exchange game scores obtained through the game in cash.

그럼에도 피고인은 2013. 11. 18.부터 2013. 12. 20.까지 위 H 오락실에서 게임기를 자동으로 실행시켜 주는 속칭 ‘똑딱이’ 장치를 구비한 후, 손님들이 500원권 동전을 게임기 동전 투입구에 넣으면 ‘CREDIT(크레딧)'창에 500점이 생성되고, 위 ’똑딱이‘ 장치를 위 게임기 위에 올려놓으면 위 황금포커성이 자동으로 실행되어 1게임당 100점씩 감소하며 포커게임이 실행되어 우연의 결과에 따라 일정 조합의 카드가 나오는 경우 점수를 획득하고, 그 점수는 ’BANK(뱅크)'창에 적립이 되는 ‘황금포커성’ 게임기 60대를 설치하고, 손님들로부터 게임물의 이용을 통해 획득한 위 뱅크 창에 적립된 금액의 반환을 요구받으면 그 금액에 해당하는 만큼 멤버십 카드(마일리지카드)에 이를 적립하여 교부하고, 손님들로부터 위 멤버십 카드의 교환을 요구받으면 그 점수에 해당하는 금액(1점에 1원으로 계산)을 제공하여 손님들이 위 게임을 다시 할 수 있게 하여 멤버십 카드에 교환가치를 부여하고, 이에 손님들이 위 게임장 내ㆍ외에서 멤버십 카드를 다른 손님들에게 판매함으로써 이를 현금화 할 수 있도록 하였다.
