Punishment of the crime

The Defendants are the owners that invested a total of 48 million won in a mutual game room of Geumcheon-gu Seoul, Geumcheon-gu, Seoul. G is the owners that invested a total of 50 million won in the game room of Geumcheon-gu, and G is the provision of 50 games in the above game room and the Defendants and the owners that engaged in the same business, H is responsible for the overall operation of the above game room, and I is the employees of the above game room.

No game products related business entity shall allow any person to gamble or perform other speculative acts using game products, or leave such person to do so.

피고인들과 G은 2011. 9. 8.경부터 같은 해 10. 31.경까지 위 게임장에서, 피고인들은 게임장을 임차한 후 게임장 시설 등을 구비하고, G은 보관하고 있던 ‘심해포카’ 게임기 50대 및 위 게임기의 시작 버튼을 자동적으로 눌러주는 속칭 ‘똑딱이’ 장치 60대를 제공하여 게임장에 설치하였다.

G이 제공한 ‘심해포카’ 게임기는 500원짜리 동전 20개가 투입되면 게임화면 크레딧 창에 10,000점이 생성되고 위 ‘똑딱이’ 장치에 의하여 게임이 자동으로 실행되어 1게임당 100점이 차감되는데 게임화면 속 5장의 카드의 그림 및 무늬가 바뀌고 그림 또는 숫자가 같은 경우 최소 100점에서 최대 150,000점까지 점수를 획득하게 하는 방법으로 게임이 진행되고 그 점수는 게임화면 뱅크 창에 적립이 된다.

The Defendants, while managing the whole business place to H, the president of the business, shall exchange the case to H or I, and if the Defendants are requested to return the amount acquired from the customers through the use of their game products, shall pay the reusable right scoophone in which the points corresponding to such amount are indicated, and if the above reusable right scoophone is requested from the customers, they shall provide the game machine with the amount equivalent to such points to the above reusable right scoophone so that customers may resume the game.
