Reasons
1. The summary of the facts charged is C representative director who is engaged in the lease and management business of Pyeongtaek-si B urban residential housing.
On December 4, 2015, the Defendant received 3,429,000 won from the victim G who entrusted the management and purchase of a household from the above company's office located in Pyeongtaek-si to sell the above company's studio E and stud F, and used 571,00 won remaining after paying 3,429,00 won for the purchase of a household at the location of the company's office around that time, and used 571,00 won for personal consumption of the remaining amount after paying 3,50,000 won for the purchase of a household at the location of the company's office. On February 2, 2016, the Defendant received 3,50,000 won for the purchase of a household from the victim J. who entrusted the purchase of a household to the above company after receiving 3,50,000 won for the purchase of a household from the bank's office at around that time, paid 3,271,000 won for personal consumption.
As a result, the defendant embezzled the property of the victims who had been under custody in the course of their business.
2. Determination
A.
