A Imprisonment with prison labor for one year, and for the crimes set forth in Section 2(a) and Section 2(b) of the Judgment of Defendant B, each of four months of imprisonment.
Reasons
Punishment of the crime
[criminal power] On March 8, 2017, Defendant B was sentenced to a suspended sentence of two years for the violation of the Act on Registration of Credit Business, etc. and Protection of Financial Users at the Busan District Court on August 8, 2017, and the said judgment became final and conclusive on March 16, 2017 and seven times the same kind of power.
【Criminal Facts】
1. Defendant A
A. A person who intends to engage in credit business, etc. in violation of the Act on the Registration of Credit Business, etc. and Protection of Financial Users (hereinafter “BS”) is registered with the competent authority having jurisdiction over the relevant place of business, but the Defendant did not register the credit business, and around March 6, 2015, the Defendant provided a loan of KRW 500,000,000 to C at the coffee shop located in the Busan Si-si, Busan, and paid KRW 4,950,000,000 after deducting 1% of the interest rate from the prior interest rate, and each share of KRW 30,000,000 per week shall be repaid by equal number of days, such as in the list of crimes in the attached Table.
B. The highest interest rate shall not exceed 25% per annum when a credit service provider without registration of credit business, etc. violates the Act on the Registration of Credit Business, etc. and the Protection of Financial Users (hereinafter “FE”) makes a loan, notwithstanding that the highest interest rate shall not exceed 25% per annum, the Defendant agreed to provide a loan of 5 million won to C at the coffee shop located in the Busan Si-si in Busan Special Metropolitan City from March 6, 2015, at a rate of 4.5 million won less the interest rate of 10,000 won per annum, and at a rate of 107.8% per annum, each share of 300,00 won, agreed to pay the principal and interest in excess of 25% per annum from March 6, 2015 to February 7, 2018.
