A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On January 5, 2015, the Defendant entered “D” in the subscriber’s signature column, and sent it to employees under the name in the KTT’s name and exercised “G” through a mobile phone agency located in Suwon-si, Suwon-si, with the intent of opening a cell phone in the name of D by advertising the copy of the D’s resident registration certificate, using PDA, and accessing the Internet via the Internet, “D”, “E”, “E”, “F in the name of the customer in the application for new subscription to the mobile phone, and “computer” in the specification receipt column. In the method of paying fees, the Defendant entered “D” in the subscriber’s signature column, “D”, and sent it to the employees under the name in the KTT’s name and omitted, and performed electronic records for the purpose of using the electronic records as recorded in the attached list of crimes, thereby exercising the right and obligation of KT for an excessive use of the electronic records.
2. The defrauded, at the time and place set forth in paragraph (1). The fact is that the Defendant opened the cell phone by stealing the name of D, and therefore, even if he/she opened the cell phone from KT Co., Ltd. even if he/she did not have the intent or ability to pay the mobile phone price, he/she, as stated in paragraph (1), got the victim’s company KT by transmitting the forged electronic data to KT manager who was aware of the above fact, thereby deceiving the victim’s company, and then, he/she acquired the victim’s 860,000 won at around January 5, 2015 after receiving the amount of KRW 60,000 from the victim’s 4 times the total market price of the mobile phone from the victim, such as in the list of crimes in the attached Form.
