1. The Defendant stated the Plaintiffs in the “amount” column in the attached Form 2’s sheet and the corresponding money on January 2, 2017.
Reasons
A. The Defendant’s remuneration rules and guidelines for handling overtime work are as follows.
[Remuneration Regulations] With respect to an employee who has worked for more than one hour, or has worked for more than one hour on a holiday, the overtime work allowance may be paid in accordance with the payment criteria set forth in attached Table 2.
Detailed matters concerning the payment of excess service allowances shall be separately prescribed by the Governor.
2. Other employees who have worked in excess of one hour or more or have worked in excess of one hour or more during the regular working hours as prescribed in the service regulations of 1.5 (Guidelines for Excess Work) of overtime work hours subject to classification rate of other allowances on the standard table for payment of remuneration or payment amount x 209 x excess work hours;
Ⅰ. Excess work allowances;
1. Allowance for overtime work;
(a) Employees employed in addition to working hours prescribed by the order for overtime work; and
(b) The standard for payment per hour / 209 hours 】 excessive working hours 】 1.5 * the scope of ordinary wages: Basic pay and special business allowances; and
(c) Scope of recognition: The hours of payment shall be recognized within 4 hours a day, 67 hours a month, and the hours recognized by the president separately in consideration of the budgetary circumstances, etc. of each year;
1. The method of paying overtime allowances;
(a) The payment date of remuneration for the following month during which the overtime work is made;
(b)In respect of those who are eligible for the payment of a fixed amount for each overtime allowance and whose number of working days during a month (or on a business trip) is not less than 15 days on the basis of a regular working day, allowances shall be paid in the amount of the individual fixed amount as follows, without any separate order or approval for overtime work within
Provided, That where the number of working days is less than 15 days, an amount equivalent to 1/15 of each day less than 15 days shall be reduced and paid.
- Grade 1 to Grade 2: Not paid - 10 hours a month per capita - Class 5 employees appointed after March 2009: 170 hours a year per capita.
