피고인은 B, C, D 와 2017. 9. 09. 21:00 경부터 같은 달 21:20 경까지 순천시 E 아파트 503동 1 층 공동 현관 앞에서 화투 20 장을 사용하여 선이( 일명 노잡이) 다섯 장씩 네 가지 패를 만들어 놓으면 참가자들이 그중 한패를 선택하여 돈을 걸도록 하고 난 뒤 다섯 장을 뒤집어 세장 숫자의 합이 10 혹은 20이 되도록 맞추어 버리고 나머지 두 장의 합이 높은 사람이 건 돈을 가져가는 방식으로 1 회당 1,000원 배팅하는 방법으로 약 7~8 회에 걸쳐 판돈 165,000원 정도의 속칭 ' 도리 짓고땡' 도박을 하였다.
