The judgment below

The part against the defendant shall be reversed.

In the first instance of the trial, the prosecutor changed the facts charged as stated in the following column of the crime, and applied the applicable law to “scambling aiding and abetting,” and applied law to “Article 246(1) and 32 of the Criminal Act, and Article 334(1) of the Criminal Procedure Act,” respectively. This court permitted this, thereby allowing this, thereby making the judgment below impossible to be maintained as it is.

Therefore, the judgment of the court below is reversed in accordance with Article 364 (2) of the Criminal Procedure Act, and it is decided as follows.

【 다시 쓰는 판결】 범죄사실 피고인은, G, H, I, J, K, L, M, N, O, P, Q, R, S, T, U, V, C 등이 2017. 1. 17. 15:00 경부터 같은 날 16:00 경까지 서울 동대문구 W 지하 1 층에 있는 도박장에서, 화투 20매를 이용하여 선이( 일명 노잡이) 다섯 장씩 네 가지 패를 만들어 놓으면 참가자들이 그 중 한패를 선택하여 돈을 걸도록 한 후 다섯 장을 뒤집어 세장 숫자의 합이 0이 되도록 맞추어 버리고 나머지 두 장의 합이 높은 사람이 건 돈을 가져가는 방식으로 1 회당 10,000 원씩 걸고 수회에 걸쳐 판돈 1,066,000원으로 일명 ‘ 도리 짓고땡’ 이라는 도박을 함에 있어, 위 도박장소에 화투 등을 준비하여 대여해 주었다.
