피고인은 C, D, E, F과 함께 2016. 5. 2. 00:30경부터 같은 날01:30경까지 창원시 성산구 G 아파트 310동 1004호에서 화투 20장을 사용하여 선(일명 노잡이)이 다섯 장씩 네 가지 패를 만들어 놓으면 참가자들이 그 중 한패를 선택하여 돈을 걸도록 하고 난 뒤 다섯 장을 뒤집어 세장 숫자의 합이 0이 되도록 맞추어 버리고 나머지 두 장의 합이 높은 사람에게 돈을 지급하는 방법으로 약 50회에 걸쳐 속칭 '도리짓고땡'이라는 도박을 하였다.
