A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On February 26, 2018, the Defendant posted a false statement to the effect that “Aphone7 is sold” by accessing “D” at a place where the place is unknown, at which the victim’s location is unknown, and then sent a false statement to “Aphone7 is to deliver 3.50,000 won to E.”
However, the Defendant did not have a phiphone7, and there was no intention or ability to send the goods even if the sales proceeds are supplied by the victim.
The Defendant, by deceiving the victim as above, received 350,000 won from the victim’s account in the name of the Defendant from the victim as the price for goods, and received total of 11,121,800 won from the date and time to September 3, 2018 as stated in the attached Table 1 from the above date and time to September 3, 2018 as the price for goods.
The Defendant, on August 26, 2018, up to 2018, up to 2018, posted a letter stating that “the 270,000 won transfered 70,000 won” to “F by using smartphones,” and then deliver a document stating that “the 270,000 won transfered 270,000 won to G.
