A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On August 20, 2018, the Defendant, “2018 Godan6877,” posted a false statement on the Internet B C website “Sales of smartphones (S7)” on the bulletin board, and reported it to the victim D who made contact.”

However, at the time of fact, the Defendant did not have the goods to be sold to the victim and was thought to use the money received from the victim for his own cost of living and for the repayment of the existing debt, and thus, the Defendant did not have the intention or ability to send the goods that the victim wants to purchase even

As such, the Defendant, by deceiving the victim, received 124,000 won from the victim to the E bank account (F) in the name of the Defendant on the same day as the price for the goods on the same day, from October 31, 2018, by deceiving the victims by the same method over 22 times, as shown in attached Table 1 of Crimes List 2018, and by remitting the victims total sum of 2,619,000 won from the victims to the same account.

On August 9, 2018, the Defendant, “The 2018 Highest 7153,” sent a false statement to the victim H, who visited the Internet B C website at the Gadodoo-si, Gasan-si, stating that “The sales of smartphone (phone 6) is sold,” and reported it to the victim H, who called, “I will send the money first.”

However, at the time of fact, the Defendant did not have the goods to be sold to the victim and was thought to use the money received from the victim for his own cost of living and for the repayment of the existing debt, and thus, the Defendant did not have the intention or ability to send the goods that the victim wants to purchase even

The defendant deceivings the victim as such, and thereby, KRW 114,00 shall be paid for the goods from the victim on the same day.
