A defendant shall be punished by imprisonment for two years.

Punishment of the crime

In order to support the stabilization of livelihood by financing the living expenses for employees suffering from a temporary difficulties due to the delayed payment of wages, the Defendant and C/D knew that the employee in the workplace who is in arrears with wages for at least one month in accordance with the Framework Act on Worker's Welfare in the Korea Workers' Welfare and Welfare Service grants a loan to the employee in arrears for at least one year, 3.0% per annum, 3.0% per annum, and 3 years with a year grace period, and forged the loan-related documents, such as a false certificate of employment, statement of benefits, and confirmation of delayed payment of wages, as if the employee did not receive wages while working in the workplace after creating a false workplace, and submitted the forged documents to the Korea Workers' Welfare and Welfare Service after receiving a credit guarantee from the company bank, which is a financing agency, to divide profits.
