Punishment of the crime
1. Defendant B’s sole criminal conduct
A. On November 22, 2011, the Defendant entered the column of service certificate form, “E Council members” in the position column, “Until October 21, 2009” in the column of service, “E Council members: F”, and “F” in the column of the preparing person’s name, and then arbitrarily sealed the seal of the newly tension in his name.
Accordingly, for the purpose of exercising, the Defendant forged a letter of employment certificate in the name of president F of E, a private document concerning a certificate of fact.
B. In the name of the legal entity that is liable to collect the withholding receipt for wage and salary income, which was sent online using the computer at the same date, time and place as the above paragraph (a) above, the Defendant entered and printed out in the name of the legal entity that is liable to collect the withholding receipt for wage and salary income, such as “E”, “F” in the representative column, “G” in the business registration number column, and “Seoul Yeongdeungpo-gu Seoul Metropolitan Government H2 floor” in the seat column
Accordingly, for the purpose of exercising a certificate, the Defendant forged a receipt for tax withholding on earned income under the name of the president F of E, a private document related to a certificate of fact.
C. On May 23, 2012, the Defendant entered “Seoul Special Metropolitan City I-dong A-dong 201,” “J” in the name column, “K” in the column of resident registration number, “L Council” in the column of position, and then printed out in the column of position as “the deputy president, the date of preparation,” “M” on May 23, 2012, and then affixed the seal of the new LA president on his/her own name.
Accordingly, for the purpose of exercising, the Defendant forged a certificate of employment in the name of the president, which is a private document related to the certification of facts.
The defendant is a computer at the same time and place as the above (c).
