A defendant shall be punished by imprisonment for one year.

Seized No. 2, 3, and 4 shall be returned to each victims.

Punishment of the crime

On October 21, 2011, the Defendant was sentenced to four years of imprisonment by the Seoul Central District Court for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) and completed the execution of the sentence in Seoul Southern Prison on August 17, 2015.

1. Embezzlements of deserted articles in possession;

A. On April 2016, 2016, the Defendant: (a) acquired a copy of a hotel’s member-based universal club; and (b) embezzled on his/her own thought that he/she had, without following necessary procedures, he/she did not return it to the victim, from a subway No. 2, the subway No. 140, a subway No. 5, which was located in Songpa-gu, Songpa-gu, Seoul; and (c) he/she embezzled on his/her own.

B. On April 2016, the Defendant: (a) acquired one of the J5 mobile phones during the gallon ju City of Samsung Gallon, which was lost by the victim C, who was placed in the lock room station of the subway No. 265, located in Songpa-gu Seoul Olympic Games; and (b) embezzled the victim’s thought to have without following necessary procedures, such as returning the victim to the victim.

On May 9, 2016, the Defendant: (a) acquired a copy of the NH C&C No. 1, the victim D lost; (b) returned it to the victim; and (c) embezzled the Defendant’s thought he/she had without following necessary procedures.

2. On June 2, 2016, at around 23:34, 2016, the Defendant: (a) abused the victim E, who was divingd while under the influence of alcohol at the subway platform platforms of subway 5 located in the subway 1097, as the Gangdong-gu Seoul Metropolitan Government, with one bank consisting of a total of KRW 400,000 won of the market price, which is the ownership of the damaged victim, and was in front of the victim; and (b) thefted with one bank that contains one bank room consisting of a total of KRW 400,00,000 of the market price of the damaged victim.
